Waivers & Liability

This page sets out the assumption-of-risk, release of liability, and medical-authorization terms that apply to every participant in a program at The Spot. A signed copy of these terms is also collected at first session, and your booking acknowledgement confirms you have read and agree to this page.
1. Assumption of risk
Athletic programs — including swimming, training, and camp activities — involve inherent risks of physical injury, including but not limited to muscle strains, sprains, fractures, dental injuries, head injuries, drowning or near-drowning, and exposure to communicable illness. These risks cannot be eliminated regardless of the care taken by staff.
By enrolling a participant, you acknowledge that you understand these risks and accept them on the participant's behalf.
2. Release of liability
To the maximum extent permitted by the law of the State of {{STATE}}, you, on behalf of yourself and the participant, release, waive, and discharge {{LEGAL_ENTITY_NAME}}, its owners, officers, employees, contractors, instructors, coaches, and volunteers (collectively, "Released Parties") from any claim, demand, or cause of action arising out of or related to participation in our programs, except claims arising from a Released Party's gross negligence or willful misconduct.
You also agree to indemnify the Released Parties for any claim brought by the participant or on the participant's behalf related to participation, except to the extent the claim arises from a Released Party's gross negligence or willful misconduct.
This section does not limit any liability that cannot be limited under applicable law, and it does not apply where the law governing the agreement prohibits a pre-injury release on behalf of a minor.
3. Medical authorization
You confirm that the participant is in good health and able to participate in vigorous physical activity. You authorize our staff to administer basic first aid and, in a perceived medical emergency where you cannot be reached, to obtain emergency medical treatment for the participant — including transport by ambulance — at your expense.
You will tell us about every allergy, medical condition, medication, and physical limitation that may affect safe participation. We will keep that information confidential and use it only for safety.
4. Authorized pickup
For minor participants, only adults named at booking as the parent/guardian or authorized pickup may collect the participant. We will check photo ID if the person picking up is not known to staff. Late pickup may incur a fee posted at the facility.
5. Media release
We may take photos or video during programs for our own marketing and social media. If you do not consent to a participant's image being used, opt out by emailing {{CONTACT_EMAIL}} before the program begins.
6. Code of conduct
We expect respectful behavior from participants, parents, and visitors. Aggressive, discriminatory, or unsafe behavior may result in immediate dismissal from a program without refund and a ban on future enrollment.
7. Acknowledgement
You acknowledge that you have read this page, that you have the legal authority to accept its terms on behalf of yourself and the participant, and that you are doing so voluntarily. If you do not agree, do not enroll in our programs.
